Refunds and Cancellations

HomeworkXpress follows a policy of no refunds unless as specified. It encourages all its students to communicate with respective tutors, assess their quality and then make informed decisions. It recommends all its students to make payments after checking out the profile information of the tutor. It allows them full liberty to discontinue the lessons if they feel dissatisfied. HWX also agrees to refund the amount collected from students in the event of any of its lessons being cancelled for good reason. However rescheduling of lessons and classes do not amount to suspension and do not qualify for refunds. HWX reserves the right to temporarily cancel and suspend any lessons or class without prior notice and schedule it on a future date. Such an act shall not amount to cancellation and does not qualify for refunds.

Deliverables

HomeworkXpress’ tutorial/educational lessons are online in nature and are designed to deliver on desktops/laptops. It may not run on certain computer systems which do not have the prerequisite software. These lessons are run by tutors or educators. It is the discretion of tutors/educators to tutor or teach whatever they want, based on their respective qualifications approved by the administration. HWX orients all of its students about the operations of its online class and educates them how they can enroll in the online class hassle free. In case any student is unable to join the class due to reasons pertaining to default on the part of HWX to deliver the class, HWX undertakes to allow the student a similar free online course lesson.

Conduct

While using homeworkXpress, you agree that you may not use the website in any unlawful manner or in any other manner that could damage, disable, overburden or impair the website. In addition, you agree not to use the HWX website to:

• upload, post, email, transmit or otherwise make available any content that we deem to be harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, pornographic, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable;

• aid or encourage a student to violate the honor code or code of conduct of the institution to which a student belongs;
• use learningXpress.com as a marketplace for services other than tutoring (such as essay writing, completion of a students’ assignments, etc.).

Tutors

By submitting your information as a tutor, you understand and agree that anyone with access to this application may view your information and your tutor profile. HomeworkXpress does not guarantee that a certain number of users or a specific person will view your information.

When you register as a tutor through the homeworkXpress application, you understand and agree that the information you provide is true and accurate and that you have the proper qualifications and expertise in the subjects you have selected at the time of registration. You are solely responsible for the form and content of all information provided and all information included in your profile.

Tutor shall use all reasonable efforts to protect tutee's interest in the information and keep it confidential, using a standard of care no less than the degree of care that tutor would be reasonably expected to employ for his/her own similar confidential information. In particular, tutor shall not directly or indirectly disclose, allow access to, transmit or transfer the information to a third party without the tutee's prior written consent. Tutor shall disclose the information only to those persons who have a need to know the information for the purpose and who have been approved by the tutee to receive the information. Tutor shall, prior to disclosing the information, issue appropriate instructions to them to satisfy its obligations herein and obtain their written agreement to receive and use the information on a confidential basis on the same conditions as contained in the agreement.

Tutor further agrees to comply with the Family Educational Rights and Privacy Act ("FERPA"), 34 C.F.R. &99 et. seq. Tutor shall regard all student information as confidential and will not disclose the student information to any third party without legal documentation requesting such information.
